IIRC for a civil summons to be properly and legally served, the plaintiff has to have such within 48 business hours of court date by a third party (e.g., civil Sheriff officer, legal processor, your next door neighbor).  The court must have also received "Notice of Service" which must be notarized or similar by the above noted deadline.  Last I checked, email is not considered a proper method for servicing a court summons, let alone any similar documentation.  I am surprised a 10 year lawyer does not know this and pulled such as well.

The prior is from Linux ETC doing collections on those rare occasions where I did all of the paper work with our general counsel doing navigation as needed.  Collections are under the civil courts as well as TRO's and RO's.  The actual verbage is also on the legal PDF forms that can be downloaded from most county's web sites if not the state's judicial web site.

As a side thought regarding this situation, is this EFF territory yet?
