I think it is just a patent on the MS Office XML DTD (is that the right
term? The thing that describes an MS Office doc structure in XML).
So not the whole of XML, just their Office XML 'schemas.'
It is a ploy -- publish the schema to appear 'open' and fair. Then
patent the schema to give them back their iron-clad grip, as they had
with their ever-changing binray-only format.
