I think he used optional in the sense that if you don't like their Service Agreement, you've got other ISP options.  Let's face it -- if you care about privacy, Juno pretty much fails to provide much and is not the best choice.  But (Juno hopes) some folks may feel that it's a fair concession to make for no-$$-fee dial-up ISP service.  It's about choice.  Those agreements, believe it or not, are available for people to read BEFORE making any decisions.

Who knows what I might be willing to sacrifice for free beer ;)

And to bring this back on topic, does anyone have a URL for linux-friendly distributed computing projects (along the lines of SETI at home)?  Somehow I don't think Juno will headline that list.  Also, are there any linux-friendly "free" ISPs left?
