It is most definitely illegal under the anti-trafficing provisions of
the DMCA, and I highly recommend that you ignore said provisions. It will
always be illegal as long as the DMCA is not repealed or stuck down by the
courts, which my lawyer friends seem to think is unlikely.
It doesn't matter if it's source, binary, or poetry form, if it has a
significant "action" component (as opposed to just purely "expression"),
and that action is to circumvent copyright protection, it is illegal.
Don't ask me how they figure out the difference, that's how things are
nowadays.
That's also why hyperlinks are not considered protected speech anymore,
while footnotes and references in the New York Times are considered
protected speech.
